Sybilla Agasee has instructed on a major Court of Appeal decision which continues to be good law, followed widely throughout the profession. (Mountney v Treharne [2002] 2 FLR 930), wherein the wife’s home was protected from the Husband’s intended defeat of the court order, by an application for his own bankruptcy.
